Collective Bargaining

In the course of negotiating thousands of collective bargaining agreements over an average of 35 years, our labor attorneys bring a firm, but fair, approach to negotiations. We are tough, but not confrontational, and develop solutions while preserving the relationship between you and the union.

 

Contract Administration

This ongoing process includes assistance with interpretation and implementation, ensuring that any action you take, such as layoffs, promotions or discipline, is in compliance with the contract.


Grievance and Arbitration

If a grievance is filed, we can help you gather information, develop a response and meet with the union on your behalf. Based on a thorough investigation and presentation of evidence, the grievance can often be quickly resolved. If, however, it goes to arbitration, we will assist you every step of the way: researching and selecting the arbitrator, preparing witnesses, gathering documents, representing you at the hearing, and filing a post-hearing brief.

 

We consider all the potential consequences of your actions to ensure compliance not only with your contract, but with state and federal labor laws as well.


Strike Preparation

Our objective in labor negotiations is to reach an agreement with the union without a work stoppage.  In some cases, however, a work stoppage is unavoidable. When a strike does occur, we’ll work closely with you to help keep operations running seamlessly.  We’ll advise you on hiring temporary or permanent replacements, unilaterally implementing your final offer, and alleviating striker misconduct.  During strikes, we will act quickly and effectively to obtain a court order to stop or limit the strike activity and keep your business productive. 

 

We take proactive steps to help you manage union activity, from prevention to arbitration, and work toward accomplishing your goals.
