Employment Litigation - Alternative Billing+

Simple and Predictable Legal Fees...with Alternative Billing+

Why give a blank check to your attorneys?

At millisor + nobil, we’re always mindful of how your defense dollars are being spent. The reality is that it’s your business, your case, and your money - - not ours. You have the right to expect an effective outcome, as well as an efficient process from your employment defense attorneys.

You should also expect certainty and predictability when it comes to the legal fees being incurred to defend your case. The traditional hourly rate billing plans without realistic budgets and periodic status reports are anything but certain or predictable. It’s hard enough to run your business profitably as it is, let alone without knowing how much legal representation will cost.

Get the power of Alternative Billing+

We don’t expect our clients to give us a blank check to defend their cases. Instead, we’re committed to exploring alternatives to traditional hourly rate billing such as flat fee or incentive billing plans.

If it's appropriate (usually with clients for whom we handle a larger volume of cases), we can proceed using our Flat Fee+ plan. At each stage of the litigation, we’ll quote a predetermined flat fee based on an analysis of critical variables at the outset of each case. This set flat fee amount is what you wlil pay for that stage of your case...regardless of how much work each stage entails or how long it lasts.

At the end of each stage, we’ll provide you with an analysis of the case and a flat fee quote for the next phase. Armed with this information, you’ll be able to make an informed decision whether to take the case to the next level or explore a resolution. This model provides the certainty and predictability you need to make sound decisions and run your business.

The Flat Fee+ model

The following example illustrates just how our Flat Fee + plan can provide you the ability to predict and control legal fees. Under our Flat Fee+ plan, you’ll pay a separate flat fee for each of the following litigation stages if, and only if, your case advances to that stage:

  • Pleading/Investigation/Preliminary Analysis: An initial Flat Fee.
  • Discovery: A Second Flat Fee.
  • Summary Judgment: A Third Flat Fee.
  • Trial: A Fourth Flat Fee.

Simple, predictable and certain. That’s the power of Flat Fee+.

What about the "plus"?

The plus is our investment in your company. Most clients are so relieved to be finished with a case that they can’t box up the files and put the experience behind them quickly enough. Similarly, most law firms are looking to move on to the next billable project now that your case is over.

But you should expect more from millisor + nobil. Each case is a learning opportunity for our clients and for us. As your partner, we add a final stage to each of your cases at our cost:

  • Post-Case Analysis: After each case is resolved, we’ll “break down the game film” at no charge to you with the goal of recommending ways to manage your risks and protect you from similar lawsuits. You’ll also have the opportunity to give us your feedback on how well we met your expectations and where we can improve future representation.

Why would we do that?

Why would millisor + nobil willingly forfeit the "no lose" hourly billing method traditionally used by most firms? The answer is simple. By handling a larger volume of your cases, we can offer you more predictable fees. And when we embrace an alternative fee structure that manages your risks while providing cost predictability, we invest in the success of your case, your business and our ongoing partnership.

We are not, and never have been, interested in "milking" cases. Our goal is to develop long term, mutually beneficial client relationships grounded in trust.
